Professional Tax (PT) Registration

Professional Tax is levied by the respective State Government Tax. It is levied on income earned by way of profession, trade or employment and collected by the Commercial Taxes Department of State Governments. In accordance with the provisions of the Act,  The States who have levied the professional tax have different slabs / rates, the tax amount varies but it is capped at Rs. 2500/-  per year.

The professional tax is usually a slab-amount based on the gross income of the professional. It is deducted from his/her income every month by the employer.

Following are some of the Indian states and union territories where professional tax are :

Andhra Pradesh, Assam, Chhattisgarh, Gujarat, Karnataka, Kerala, Maharashtra, Madhya Pradesh, Meghalaya, Odisha, Sikkim, Tamil Nadu, Telangana, Tripura, and West Bengal.

Arunachal Pradesh, Himachal Pradesh, Delhi, Haryana, Uttar Pradesh, Uttarakhand, Andaman and Nicobar Islands, Daman & Diu, Dadra and Nagar Haveli, Lakshadweep and Jammu & Kashmir

Key Points

Professional tax registration application must be submitted to the State’s tax department within 30 days of employing staff in a business. As per the jurisdiction of the authority, if there is more than one place of work, the application must be made separately to each authority as regards the place of work.

Persons, carrying freelancing business without any employees are also required to register themselves subject to the monetary threshold provided by the respective State’s legislation.

Professional tax levy is subject to the exemption provided by the respective State to certain categories such as parents or guardian of any person who is suffering from mental retardation, blind persons are exempted. 

Penalty of Rs. 5/- per day will be applicable if you are delayed to obtain PT Registration and in case of non/late payment of profession tax, penalty will be 10% of the amount of tax.

In case of late filing of returns, a penalty of Rs. 1000 per return will be imposed if you filed after due date in 1 month. After 1 month, a penalty of Rs. 2000 will be imposed.
